Meet Us

As a client of Brooks Injury Law, you'll meet the paralegal and attorney on your case right away. To meet the needs of our clients, all of this can be in person, online, or over the phone. We can all process all necessary paperwork online from the convenience of your cell phone.

Treatment

Let us take care of everything while you focus on treatment. Our paralegals and attorneys take detailed notes of any pain you've felt as a result of your accident. Our #1 priority is making sure you get better. While you treat for your injuries, you can rest assured that we're handling your case for you behind-the-scenes. We'll keep you in the loop for any changes in your case and check in with you to make sure your treatment is going well.

Investigation

We'll deep dive into all the facts of your case. We will take over communicating with the insurance companies involved, gather all evidence, including police reports and video, 911 audio, incident reports, and more, and protect all evidence to refer to later in the case. We'll also gather your medical records to help prove your case. This will form the foundation of your demand for settlement.

Demand

Here, we'll put together a demand package to the insurance adjuster that includes every financial and physical damage you've sustained since your incident. This will encompass things like medical bills, lost wages, out-of-pocket expenses, and even the cost of any future medical treatments you require because of the incident. Once you approve it, we'll send this demand to the insurance company, and begin negotiations. You'll be involved in this entire process, so you'll always know where you stand during these negotiations.

Through thorough negotiations and a bit of patience, both parties will agree on terms of settlement for your injuries. Our service, however, doesn't end here. If settlement terms cannot be agreed upon or if the legal statute to file your case is quickly approaching, you and your attorney may decide that filing a personal injury lawsuit is the best option. Once a lawsuit is filed with the courts, we'll enter the Discovery phase. The representatives from each party, attorneys for both the Plaintiff and Defendant, will gather as much information and evidence as possible. Both sides will request written responses to a host of questions regarding the facts and timeline of the incident. The goal here is to collect all information available that can possibly be used before a judge in a court of law.

A vast majority of cases settle before ever having to step into a courtroom. However, if an agreement for settlement cannot be reach in any previous stage, we'll take your case to trial on a date set by the courts. A jury will be selected, statements will be read, and witnesses will be called. Trials can last anywhere from a few hours to a few weeks.

Here, the jury will deliberate on all the facts it has been presented from both sides. At the end of deliberation, it will decide at what percentage each party is at fault, and how much the at fault party should pay to those it has hurt.

After the case is successfully resolved in court, a check for your settlement will be issued and a final statement, less any fees and court costs, will be drafted for your approval.
